Welcome! These Terms of Service ("Terms") are an agreement between you and Comet Frequency ("we," "us," "our"). They cover your use of shohamcapital.com (the "Site") and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. If you don't agree, please don't use the Site.
Our Shipping Policy, Refund & Return Policy, and Privacy Policy are part of these Terms.
1. Who can buy
You must be at least 18, or the age of majority where you live. If you're younger, you may use the Site only with a parent or guardian who agrees to these Terms. We sell only to customers with shipping addresses in the United States (see the Shipping Policy).
2. Our products
- Where items ship from. Most items ship from our production partner. Some items ship from our own location.
- Colors and sizing. We try to show products accurately, but colors on your screen may look a little different from the finished product. Design placement can vary slightly from item to item. Please check the size chart on each product page before ordering.
- Our designs and messages. Some products carry humor, seasonal, civic, or cause-related messages. These are designs we sell. They aren't endorsements by any candidate, party, government, or organization.
3. Orders, pricing, and payment
- All prices are in U.S. dollars. Sales tax is added at checkout where required.
- When you place an order, you're making an offer to buy. We accept it when we ship the item. We may refuse or cancel any order, or limit quantities. Reasons include suspected fraud, a pricing or listing error, or an item that's no longer available. If we cancel an order after you've paid, we'll refund you in full.
- If a product's price or description has an obvious error, we may correct it and give you the choice to continue at the correct price or cancel for a full refund.
- Payments are processed by our checkout provider. By paying, you confirm you're allowed to use that payment method.
4. Shipping, returns, and refunds
Shipping times, return rules, and refund rules are explained in our Shipping Policy and Refund & Return Policy. In short, all sales of production-partner items are final except for items that arrive defective, damaged, or wrong. Those are replaced or refunded as long as you tell us within 30 days of delivery. They can't be returned for a change of mind or the wrong size. Unused items that ship from our stock can be returned within 30 days of delivery. When the carrier has your package, it is considered delivered to you, but we'll still help if it's lost (see the Shipping Policy).
5. Using the Site
Please don't:
- break any law, or use the Site to commit fraud,
- try to hack, overload, scrape, or disrupt the Site, or get into parts of it you're not authorized to use,
- resell our products in a way that suggests you're us, or
- copy or reuse our designs, photos, or text without permission.
We may suspend access for anyone who breaks these rules.
6. Our content and designs
The designs, artwork, product photos, text, and logos on the Site belong to Comet Frequency or our licensors and are protected by copyright and trademark laws. Buying a product gives you the right to own and use that product. It doesn't give you any right to copy the design.
Intellectual property concerns: if you believe something on our Site infringes your copyright or trademark, email contact@shohamcapital.com with:
- the item,
- the right you hold, and
- your contact details.
We'll review it promptly and remove the item if needed.
7. Reviews, photos, and messages you send us
If you send us a review, photo, idea, or other content, you confirm it's yours to share. You also give us permission to use, display, and share it in connection with our store, for free. We will not publish photos you send us about an order problem without asking you first. We may remove content for any reason.
8. Other companies' services
Our Site uses services from other companies, such as our checkout provider, payment processors, and shipping carriers. It may also link to other websites. We don't control those companies or websites and aren't responsible for them. Their own terms and privacy policies apply.
9. Disclaimers
Except as stated in our Refund & Return Policy, and to the extent the law allows, the Site and products are provided "as is." We don't make any other promises or warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose. Some states don't allow these limits, so they may not apply to you. Nothing in these Terms limits any rights you have under consumer protection laws that can't be waived.
10. Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental, special, or consequential damages. If we are liable to you for anything related to the Site or a purchase, our total liability won't exceed the amount you paid for the product involved. This doesn't limit liability that the law doesn't allow us to limit, such as liability for fraud, or for death or personal injury caused by negligence.
11. Your responsibility
If you break these Terms or the law, and that leads to a claim against us, you agree to cover our reasonable losses and costs from that claim, to the extent the law allows.
12. Resolving problems
If you have a problem with an order, email contact@shohamcapital.com first. Most problems can be fixed quickly that way. If we can't resolve it informally within 30 days, either of us may bring a claim in small claims court, or in the state or federal courts located in New Mexico, unless the law of your state gives you the right to bring it where you live.
13. Governing law
These Terms are governed by the laws of the State of New Mexico and applicable U.S. federal law, without regard to conflict-of-law rules. This choice of law doesn't take away any consumer protections you have under the laws of the state where you live.
14. Changes
We may update these Terms from time to time. The date at the top shows when they last changed. Changes don't apply to orders placed before the change.
15. Other legal terms
If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a term right away, we haven't given up the right to enforce it later. These Terms, together with the policies listed above, are the entire agreement between you and us about the Site and your purchases.
16. Notice for California customers
Under California Civil Code §1789.3, California users are entitled to the following notice:

- Charges: we don't charge anything to use the Site. You pay only the product prices, sales tax, and any shipping shown at checkout.
- Complaints: to resolve a complaint or get more information, email contact@shohamcapital.com. You may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
